Anguished Faces

Question: can they put a picture of a person in the paper without their consent? e.g. do they have to chase them down and get a written release?

NYTimes today:

"The anguish of tragic memories was apparent on the faces of relatives and friends..."

Imaginary conversation: "Hi, yes, er, excuse me ma'am, I'm from the New York Times. Do you mind if I put a picture of your anguish on our front page? Yes? Just nod. There ya go... Great, just sign here. Mm hm ok. Thanks!"
